The Attorney General (AG) has strongly opposed the application by the former Vice President Prof. Gilbert Bukenya to stop his prosecution in the Anti-Corruption Court.
In his submission, the Principal State Attorney Henry Oluka said that Prof. Bukenya should not be allowed to use the courts of law to curtail the provisions of the constitution.
โTo stop the IGG and the DPP from exercising their powers, would be a breach of the Constitution. It would also fetter the spirit of the Constitution where it is provided that the power is derived from the people,โ Oluka said.
He argued that it would be contrary to the letter and spirit of the Constitution that the power derived from the people shall be exercised by the courts established in the name of the people.
This was today (Thursday) during a hearing of Bukenyaโs application in which he is seeking to stop his prosecution at the Anti-Corruption Court pending the hearing and determination of his constitutional petition challenging the constitutionality of his cases.
