Anti- Corruption Court Chief Magistrate Irene Akankwasa on Monday remanded Bukenya after she committed him to High Court to face trial.
Section 168 of the Chief Magistrate‘s Act, stipulates that once an accused person is committed to High Court for trial his or her bail shall be cancelled.
Bukenya’s lawyer MacDosman Kabega, however opposed the committal saying the mandate to commit an accused person is only given by the Constitution to Director of Public Prosecution (DPP) Kabega argued that Inspectorate of Government (IGG) does not have the mandate to commit an accused person.
Kabega added that if IGG is to commit he can only do so after seeking permission from the DPP but not single handedly.
The director of legal affairs from the Inspectorate of Government said the Inspectorate can investigate, prosecute and has the power to commit an accused person for trial
He cited the cases of former NSSF director and former NSSF board chairman Godfrey Onegi Obel who were committed by the IGG to High Court Anti- Corruption Division to face trial.
