Kampala- Indicted businessman Apolo Senkeeto has pleaded to the Inspector General of Government (IGG) to stop criminal proceedings against him over the Shs24.7 billion loss in the botched Mukono-Katosi road project.
Mr Senkeeto has asked the IGG to reconsider the decision to investigate and prosecute him for corruption because he is not a public officer.
On January 4, 2018, Mr Senkeeto wrote to the IGG, saying investigations against him and Eutaw Construction Company expose unprecedented incompetence, which has led to loss of more than Shs350b by government.
“I am writing to you under two heads by way of petition to request you to investigate the company known as SBI which was contracted by the Uganda National Roads Authority (UNRA) to upgrade Mukono-Kyetume-Katosi/Kisoga-Nyenga Road in place of Ms Eutaw Construction Company Inc and by way of an appeal to you to follow the law and stop my prosecution,” Mr Senkeeto wrote to the IGG, who is prosecuting him for alleged corruption.
Mr Senkeeto, alias Mark Kalyesubula, was the country representative of Eutaw Construction Company, which is accused of fleecing UNRA of Shs24.7 billion in a dubious advance payment for the road project.
This is one of the several futile attempts Mr Senkeeto has employed to halt his prosecution by the IGG. On December 6, the Anti-Corruption Court in Kololo dismissed his petition seeking orders to block the IGG from prosecuting him. He argued that the IGG could not prosecute him for corruption yet he is not a public officer and asked the High Court to refer his case to the Constitutional Court for interpretation. However the trial judge dismissed his petition for lack of merit and said the IGG had all the power to prosecute him over corruption.
On December 18, his lawyer, Mr Peter Mulira, boycotted court and trial judge Lawrence Gidudu adjourned the hearing to February 12 to enable him find another lawyer to complete his defence submissions.
