The Court of Appeal has directed the Inspector General of Government (IGG) to immediately prosecute interdicted commissioner for land registration Sarah Kulata Basangwa in the Anti-Corruption Court.
In the judgment, justices Solomy Balungi Bossa and Kenneth Kakuru directed that Kulata’s prosecution proceeds without delay, stating that Section 19 (1) (C) of the IGG Act does not stop it from investigating fraud or any other criminal activity resulting from a matter that is subject of civil proceedings.
However, retired Deputy Chief Justice Steven Kavuma, who constituted the panel, did not append his signature to the ruling that was arrived at in January this year.
The justices disagreed with Kulata’s lawyer, Michael Okecha, who earlier submitted that the law prohibits the IGG from prosecuting Kulata in a criminal matter emanating from the same facts as that in a subsisting civil suit.
