Parliament Budget Director Guilty Of Embezzlement

The Anti-Corruption Court has found Samuel Wanyaka, the former director of budget at parliament guilty of misappropriating more than Shs 882m.

Wanyaka, this morning appeared before Justice Paul Mugamba who found him guilty of embezzlement, abuse of office and false accounting by a public servant.

In his ruling, Justice Mugamba noted that Wanyaka received the money in question but didn't put it to the use that it was requisitioned for.

The Judge said that Wanyaka did fictitious accountability as a coverup for the unaccounted money that had ended up on his Stanbic bank account at Forest Mall Lugogo.

โ€œFor the reason I have given above, I convict the accused on the charge of embezzlement,โ€ ruled Justice Mugamba.

Justice Mugamba's ruling deviates from the joint advice of two court assessors who had asked him to acquit Wanyaka for lack of evidence from the Inspectorate of Government (IGG).

On the count of abuse of office, Justice Mugamba noted that Wanyaka was entrusted with public funds that needed accountability but he never accounted for them.

On the count of false accounting by a public officer, the judge said it was the accused who requisitioned for the funds in question and that there was evidence that he is the one who furnished false accountability to coverup for his acts.

โ€œI part from the company of two court assessors and I convict the accused on all the three counts charges,โ€ he said.

According to the charge sheet, Wanyaka committed the three offenses between August 13 and December 9, 2013. The money in question was meant for service delivery surveys across the country.

Wanyaka's woes begun in early 2013 following a complaint of alleged corruption by a whistle-blower to the IGG against the official. Wanyaka faces up to 14 years in jail for the charge of embezzlement, seven years for abuse of office and three years for false accounting.
